Brooklyn rapper D.Chamberz (Duval Chamberlain) has filed a complaint in Brooklyn federal court, claiming that Ice Spice's 2023 hit "In Ha Mood" bears a "strikingly similar" resemblance to his own 2021 track "In That Mood." The lawsuit targets Ice Spice (Isis Naija Gaston), her producer RiotUSA (Ephrem Lopez, Jr.), and major record labels Universal Music Group, Capitol Records, and 10K Projects.
D.Chamberz's attorneys assert that a thorough comparative analysis of various elements, including beat, lyrics, hook, rhythmic structure, metrical placement, and narrative context, demonstrates that "In Ha Mood" is a "forgery." The complaint highlights the song's success and alleges that the similarities between the two tracks are too significant to be purely coincidental.
To establish "access," a crucial element in copyright lawsuits, D.Chamberz's legal team points to instances where the rapper shared "In That Mood" on social media and gained significant airplay on New York City radio stations. The lawsuit also notes Riot's alleged Instagram story, listening to a radio station just before D.Chamberz's song was played, and emphasizes Riot's connection to DJ Enuff, a prominent radio personality actively engaged with D.Chamberz's social media content.
